Release and Consent
I, the undersigned, have read, understand and agree that I and my child will abide by the Rules governing the Ministry of Health Promotion (“MHP”) Video/Poster Contest (as set out in this Entry Form) and certify that all information contained in this completed Entry Form is true and accurate.
I, the parent or guardian of the above-named minor, agree that s/he may participate in the MHP Video/Poster Contest. I have read this Release and Consent and the Notice of Collection before signing and understand the contents. I understand that by giving this Consent, I am permitting the MHP to use and disclose my child’s personal information for the purposes described above.
By signing this Entry Form, I give the MHP the right and permission to: (i) use and publicly disclose my child’s name, age, grade and/or prize information for promotional or other purposes, without compensation; and (2) to copy, modify, play and use the Video/Poster, accompanying this Entry Form in whole or in part, without compensation. If my child’s entry is selected as a winning entry, I consent to the MHP taking and displaying my child’s photograph in public, promotional materials related directly to the contest.
The Video/Poster has been originally and lawfully created by my child or my child’s team and the use, modification, play or reproduction of the Video/Poster by the MHP will not give rise to any third party claims for infringement or violation of copyright, trademark or any other right of any third party, or to any third party claims including libel, defamation, violation of privacy or contract breach. I and/or my child have obtained all necessary permissions, consents, licenses, or other approvals of any and all team members, and third parties (including, but not limited to, all individuals appearing in the Video/Poster and all holders of copyright in any copyrighted music, images or other materials used in the Video/Poster) necessary or appropriate for the preparation or use of the Video/Poster. I and my child release the MHP from any liability in connection with participating in this contest, or the preparation or use of the Video/Poster and agree to indemnify the MHP for any liability and all reasonable costs arising from any third party action, claim or proceeding commenced against the MHP because of the Video/Poster.
Eligibility:
- This contest is open to all residents of Ontario who are between the ages of twelve (12) years and fifteen (15) as of Friday, April 25, 2008. You are ineligible to enter this contest if you are a family member of a Ministry of Health Promotion (“MHP”) employee. Ineligible entries will be immediately disqualified.
- There will be two separate categories (one for Videos and one for Posters). Videos must be a minimum of thirty (30) seconds in length and a maximum of two (2) minutes in length. Posters must be no larger than one piece or Bristol board (22 x 28 inches/55.9 x 71.1 cm) and no smaller than piece of letter size paper (8.5 x 11 inches/21.6 x 27.9 cm).
- Each contestant may submit only one original entry in each category, either alone or as part of a team effort. A separate Entry Form must accompany each submission. Video teams may consist of a maximum of five (5) contestants. Poster teams may consist of only two (2) contestants.
- Each contestant must certify on the Entry Form that the Video/Poster submission is an original work by the contestant or his/her team and must grant the MHP unrestricted use and reproduction rights for any purposes.
- Your Video/Poster must be entirely your (or in the case of a team effort, your team’s) own original creation. It must not infringe upon or violate any laws or any third party rights, including, but not limited to, copyright, patent, trademark, trade secrets or other proprietary rights and must not lead to any cause of action including libel, defamation, privacy violation, contract breach or tort. Contestants must obtain all necessary permissions, licences, clearances, releases, waivers of moral rights and other approvals from third parties (including but not limited to all copyright holders and all individuals appearing in the submission), necessary to use the submission, in whole or in part, in any way, including without limitation, to reproduce, make derivatives, edit, modify, translate, distribute, transmit, publish, licence and broadcast the submission worldwide, by any means.
- Your own personal safety and the safety of your cast, crew, and others involve with the production of the submission must be maintained at all times.
- No entries will be returned. All entries become the sole property of the MHP.
- Three prizes will be awarded in the Video category and three
prizes will be awarded in the Poster category.
First prize: 160GB iPod classic (estimated retail value $369.00)
Second prize: 8GB iPod nano (estimated retail value $209.00)
Third prize: 2GB iPod shuffle (estimated retail value $55.00)
- Before collecting a prize, each winner and his/her parent or legal guardian may be required to sign a standard declaration and release form confirming compliance with the contest Rules, and acceptance of the prize as awarded and assigning all rights, titles and interests in the entry to the MHP.
- You must obtain your parent’s or guardian’s authorization before participating in the contest. In the case of a team effort, each member of the team must obtain parental or guardian consent.
- Each contestant irrevocably and in perpetuity grants the MHP, without compensation, the right to use the Video/Poster submission, in whole or in part, in any way, including without limitation, to reproduce, make derivatives, edit, modify, translate, distribute, transmit, publish, license and broadcast the Video/Poster submission on the MHP website worldwide, by any means or for any length of time it deems appropriate.
- The chances of winning a prize depend on the total number and quality of eligible entries received prior to the closing date.
- The MHP reserves the
right to cancel, terminate, modify or suspend the contest
for any reason, without any prior notice to any contestant.
Selection of Awards:
General Information:
A maximum of five (5) iPod products will be awarded to winning submission(s) created by a team. Two (2) iPod prizes will be awarded to winning Poster submissions created by a team.
- In the case of a team effort, the MHP will provide a maximum of five (5) prizes per team to Video winners and two (2) prizes per team to Poster winners.
- Entries will be judged using a two-stage process. The first stage consists of peer voting on the MHP website. This score will count as twenty-five (25%) percent of the final score. The second stage will consist of a panel of judges to be chosen by the MHP. The second stage score will count as seventy-five (75%) percent of the final score. The decisions of the judges on all matters relating to the contest are final and not open to dispute.
- Each individual or team member who submitted a winning entry will be notified by telephone or email that his/her entry has won and the procedure to follow to claim the applicable prize. If an individual or one or more team members decline the prize, the prize may be forfeited and awarded to another entry in accordance with these contest rules. Only the winning entries will be notified. A list of the winners will be posted on www.notgonnakillyou.ca.
- If the MHP does not receive entries of sufficient quantity or quality, the MHP reserves the right not to award any prizes.
- Each contestant or team may submit only one Video and one Poster submission. Each submission must be accompanied by a separate Entry Form. Entries can be submitted by uploading them to the website in PDF format for the poster and MPEG format for the video. Video submissions will also be accepted by mail or courier in DVD-R format. Multiple entries will not be accepted.
- Submissions can be received starting on Thursday March 20,
2008 at 4:00 p.m. and must be received by the MHP before 4:00
p.m. on Friday, April 25, 2008.

TORONTO, Ontario, M7A 1S5 - All entries must be clearly labelled with your Video/Poster title, your name, mailing address and telephone number. Where more than one student has been involved, the entry must be clearly labelled as a team effort.
- Your completed Entry Form must accompany your submission. If the entry is a team effort, page 2 of the Entry form must be completed.
- The MHP is not responsible for entries that are delayed, lost, misdirected, incomplete, damaged or destroyed. Entries are subject to verification and will be declared invalid if they are tampered with, unreadable, illegible, incomplete, garbled, mechanically reproduced, mutilated, forged, or falsified.
- Each properly labelled submission accompanied by a properly completed Entry Form shall be considered a valid entry, unless it contravenes the Rules.
- These Rules may be changed without notice or reason including, if necessary, to comply with any applicable law. By entering this contest, contestants agree to abide by the Rules and acknowledge that the MHP shall not be responsible for any damages, costs, demands, claims or losses of any kind, incurred by any contestant as a result of participation in the MHP Video/Poster Contest.
- This Contest shall be governed by and construed in accordance with the laws of the Province of Ontario and any applicable federal laws. These rules govern all aspects of the contest and are binding on all contestants and all other participants including parents, legal guardians and team members who sign the Entry Form.
- The MHP is not responsible for any failure of the website during the contest period or for any problems or technical malfunction of a telephone or broadcast network or lines, computer on-line systems, servers, access providers, computer equipment, software, failure of any e-mail, on-line, or Internet entry to be received by the MHP on account of technical problems or traffic congestion on the Internet or at any website, or any combination thereof that may affect an individual’s ability to participate in the Contest, or for any injury or damage to any person or to an entrant’s or any other person’s computer or property related to or resulting from playing or downloading any material in connection with the Contest.
- Any attempt to deliberately damage any website or to undermine the legitimate operation of the Contest will render any entry or entries submitted by that individual/team void and may be a violation of criminal and civil laws, and should such an attempt be made, MHP reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution.
- In the event of a dispute as to the identity of a winner, the winning entry will be deemed to be made by the authorized account holder of the e-mail address at the time of entry. The authorized account holder is the natural person who is assigned an e-mail address by an Internet service provider or other organization responsible for assigning e-mail addresses for the domain associated with the e-mail address in question. A winner may be required, in the sole discretion of MHP, to provide MHP with proof that he or she is the authorized account holder of the e-mail address associated with the selected entry.
- By entering the Contest, the contestant (and/or his/her parent and/or legal guardian) agrees that the MHP shall not be responsible or liable for any losses or injuries of any kind resulting from participating in the Contest or acceptance, possession and/or use or misuse of any prize and agrees to release, discharge and hold harmless the MHP , its employees, advertising and promotional agencies, and the prize suppliers from all claims or damages arising out of his/her participation in the Contest and/or acceptance, use or misuse of any prize.
